Acceptance
By accessing or using Lightning Research services ("Services"), you agree to be bound by these Terms of Service. If you are using the Services on behalf of a company, you represent that you have authority to bind that company to these terms.
Service Description
Lightning Research provides a device fingerprinting and intelligence platform, including APIs, SDKs, dashboards, and analytics. The platform comprises LR Trace (device fingerprinting), LR Shield (VPN/proxy detection), LR Guard (bot protection), LR Insight (behavioral analytics), and LR Intel (threat intelligence). Services are provided "as is" and subject to the availability and limitations of your subscription plan.
User Obligations
You are responsible for maintaining the security of your account credentials and API keys. You must notify us immediately of any unauthorized use. You agree not to share API keys or attempt to circumvent usage limits. You may not use the Services to violate any applicable law, collect data without proper legal basis, or reverse-engineer our algorithms.
Payment and Billing
Free tier usage requires no payment. Paid plans are billed monthly or annually in advance. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' written notice. Failure to pay may result in service suspension.
Intellectual Property
All intellectual property rights in the Services, including algorithms, models, documentation, and trademarks, remain with Lightning Research. You retain ownership of your data. By using the Services, you grant us a limited license to process your data solely for the purpose of providing the Services.
Data Processing
We process device fingerprint data on behalf of our customers as a data processor. Customers remain data controllers for data collected through their integrations. A Data Processing Agreement (DPA) is available upon request for enterprise customers. We implement appropriate technical and organizational measures to protect all data.
Service Level Agreement
We design for high availability. Specific uptime targets, maintenance windows, and remedies (including any service credits) are defined in your order form or enterprise agreement where applicable — ask us for the current SLA addendum. Scheduled maintenance is communicated in advance when possible.
Liability
To the maximum extent permitted by law, Lightning Research shall not be liable for indirect, incidental, special, or consequential damages. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Lightning Research from any claims, damages, or expenses arising from your use of the Services, your violation of these terms, or your violation of any third-party rights.
Termination
Either party may terminate at any time with 30 days' notice. We may suspend or terminate your account immediately for violation of these terms. Upon termination, your data will be deleted within 30 days unless legally required to retain it. Sections relating to liability, indemnification, intellectual property, and governing law survive termination.
Modifications
We may modify these terms at any time. Material changes will be communicated via email at least 30 days before they take effect. Continued use of the Services after the effective date constitutes acceptance of the modified terms.
Governing Law
These terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware. For questions about these terms, contact us at legal@lightningresearch.ai.
